Shell V-Factor 2008 Promotion

Competition Terms and Conditions

1. This promotion is open to residents of England, Scotland and Wales only, excluding employees of Shell U.K. Oil Products Limited (the “Promoter”) and BBC Worldwide Limited and their affiliate companies, and their families, agencies, advisors, franchisees, suppliers and any persons assisting in the promotion. This includes any syndicate or collection of persons acting in concert, any person entering via an agent or which is an entity carrying on the business of entering prizes promotions.

2. Participants must be 18 years or over and hold a valid and clean (not carrying any penalty points) UK driving licence.

3. The promotion runs from noon 28th August 2008 to noon 27th January 2009. To enter participants need to register their personal details at www.topgear.com/shellvfactor any time from noon 28th August 2008.

4. No purchase necessary.

5. The promotion consists of five monthly competitions, each with a first and two runners-up prizes, and the grand prize driving events comprising the Daytona Milton Keynes go-karting qualifying event for the V-Factor final followed by the final itself at Top Gear Live at MPH 2008 at Birmingham NEC.

6. The winner of a monthly competition will be the participant who correctly answers the competition’s 20 quiz questions or, in the event of more than one person correctly answering all such questions, the winner’s name will be drawn at random from the names of those participants who have correctly answered the questions. In addition to competing for monthly prizes, participants’ online quiz results will put them in the running for the go-karting qualifying event at Daytona Milton Keynes. The persons filling the top 20 positions on the V-Factor leader board on www.topgear.com/shellvfactor as at noon on 2nd November 2008 will be invited to attend the qualifying event at their own expense. The top three drivers, as decided by the event organisers on the day, will then go forward to compete in the V-Factor final at Top Gear Live at MPH 2008 at Birmingham NEC.

7. Subject to Clause 10, prizes are as follows:
 
a) Grand prize and runners-up prizes
 
- Grand prize – A trip for two people to the Australian Formula One Grand Prix to be held on 29 March 2009 in Melbourne, Australia. The prize includes return economy flights from the winner’s nearest airport in Great Britain to Melbourne, three star hotel accommodation (room only) for four nights in Melbourne and Grandstand tickets to the Australian Formula One Grand Prix on Saturday 28th and Sunday 29th March 2008. The prize does not include UK airport transfers or travel insurance. Additional expenses not outlined above are to be paid by the winner.
 
- First runner-up: Shell fuel vouchers to the value of £100
- Second runner-up: Shell fuel vouchers to the value of £50
 
b) Monthly competitions
 
i) Competition 1
 
- First prize: One size 54 men's leather Ducati bike jacket, one sweatshirt and one cap signed by Casey Stoner. Jacket size is not changeable.
- 2 runners-up prizes: 1 sweatshirt and 1 cap signed by Casey Stoner each
 
ii) Competition 2
 
- First prize: £500 of Audi merchandise
- 2 runners-up prizes: £250 of Audi merchandise each
 
iii) Competition 3
 
- First prize: A trip for two people to the Ferrari factory at Maranello, Italy. Prize includes return economy flights from the winner’s nearest airport in Great Britain to Bologna, airport transfers, one night’s 4 star hotel accommodation and all meals in Italy. UK airport transfers and travel insurance are not included. Additional expenses not outlined above are to be paid by the winner. 2009 factory tour dates will be available in early 2009 and will be made known to the winner for an agreed tour date subject to Ferrari availability.
- 2 runners-up prizes: One Ferrari cap signed by Felipe Massa
 
iv) Competition 4
 
- First prize: Shell fuel vouchers to the value of £200
- 2 runners-up prizes: Shell fuel vouchers to the value of £50 each
 
v) Competition 5
 
- First prize – Tickets to the live filming of Top Gear TV, Annual Subscription to Top Gear, Top Gear merchandise and DVD
- 2 runners-up prizes – An annual subscription to Top Gear magazine and Top Gear merchandise

8. The opening and closing dates for submission of entries to each monthly competition is as follows:
 
Competition 1 – 28th August to 15th September 2008
 
Competition 2 – 16th September to 1st October 2008
 
Competition 3 – 29th October to 25th November 2008
 
Competition 4 – 26th November to 28th December 2008
 
Competition 5 – 29th December 2008 – 27th January 2009
 
The Daytona Milton Keynes go-karting qualifying event will be held on the morning of Friday 14th November 2008. The V-Factor final at Top Gear Live at MPH 2008 will be held in the afternoon of Friday 14th November 2008 at Birmingham NEC. Participants will be responsible for travel costs to and from both driving event locations. All costs and expenses not set out above are for the participants’ account.

9. The monthly draws will take place on 15th September, 2nd October, 26th November and 29th December 2008 and 28th January 2009. Winners will be advised by telephone in less than 7 days after each draw. Where applicable, prizes will be sent by courier. All postage costs will be paid by the Promoter.

10. The prizes are as stated and cannot be sold or exchanged for cash, goods or services. Unless specifically agreed in writing by the Promoter, the prize must be taken by the winner in person. In the event of unforeseen circumstances beyond the Promoter’s control, the Promoter reserves the right to provide alternative, similar prizes of equal or greater value.

11. Participants in the Daytona Milton Keynes go-karting qualifying event and V-Factor final are required to (a) sign waivers to acknowledge the inherent risk in driving activities and to agree that, in so far as permitted by applicable law, neither the Promoter nor its agents assume liability for physical injury arising from the experience (b) produce their driving licences for inspection prior to taking part in the driving activities. The Promoter or its agents reserve the right to exclude participants from taking part in any driving activities if (a) their driving licence is not in accordance with Clause 2 above or (b) at the sole and absolute discretion of the Promoter or its agents, a participant’s medical condition could compromise his/her safety or that of other participants.

12. To the extent only permitted by applicable law, the Promoter reserves the right to use (and allow its agents to use) winners’ voices, images, photographs, names and likenesses for publicity and in advertising, marketing or promotional material and all intellectual property and moral rights in respect of the same vest automatically and entirely and exclusively with the Promoter without additional compensation or prior notice to the winners and in entering the promotion all participants consent to the same.

13. By accepting a prize, winners agree to hold the Promoter, its affiliate companies and its agents harmless against any and all claims and liability arising out of the award of or the use, misuse or redemption of any prize. Where the law implies warranties or conditions, which cannot be excluded, the Promoter’s liability for breach of those warranties or conditions is limited to resupplying the prize (or paying for the costs thereof), where this is permitted by law. To the extent permitted by applicable law, winners assume all liability for any injury, loss or damage caused or suffered, or claimed to be caused or suffered by participation in this promotion or use, misuse or redemption of any prize other than due to the negligence of the Promoter or its agents and shall procure that their guests have read and understood and are happy to be bound by these terms and conditions before inviting them.

14. To the extent permitted by applicable law, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or these terms and conditions at any time and for any reason, either in whole or in part, with or without notice.

15. The Promoter’s decision on all matters is final. No correspondence will be entered into.

16. The name and counties of winners will be made available on request to those sending their name and address to BBC Top Gear, 201 Wood Lane, 2nd Floor Garden House, London. W12 7TQ

17. All personal data submitted as part of the promotion will be stored and processed on behalf of the Promoter as data controller in accordance with applicable data protection laws.

18. Neither the Promoter or its agents shall be liable under or in connection with these terms and conditions, the promotion or the use or redemption of any prize for any indirect, special or consequential cost, expense, loss or damage even if such cost, expense, loss or damage was reasonably foreseeable or might reasonably have been contemplated by the participant and the Promoter or its agents and whether arising from breach of contract, tort, negligence, breach of statutory duty or otherwise.

19. Neither the Promoter nor its agents accept responsibility for (1) lost, late or undelivered entries or (2) any technical or access issue, failure, malfunction or difficulty that might hinder entry to the promotion or (3) any event beyond their control which may cause the promotion to be disrupted or corrupted.

20. By entering the promotion participants will be deemed to have accepted and be bound by the terms and conditions which will be interpreted in accordance with English law and subject to the non-exclusive jurisdiction of the English courts.
